Terms of Service
These Terms form a binding agreement between you and OPSoft Inc. By creating an account or otherwise using the “One My Day” app, you agree to these Terms in full.
If you are located in the Russian Federation, please read the Russian-language version of these Terms — your contract is with a different legal entity.
1. Parties
“Operator” — OPSoft Inc., a Wyoming corporation, 30 N Gould St Ste R, Sheridan, WY 82801, United States.
“User” — you, a natural person aged 18 or older, using the App.
2. What “One My Day” is
“One My Day” is a personal journaling app offering:
- manual entries with photos, mood, place and weather;
- an AI interview (voice or text) that helps shape your thoughts into a post;
- AI commentary on posts and AI memory of the user;
- ephemeral chats with other users (anonymous, disappearing messages);
- public links to individual posts at the user’s discretion;
- “recap” — aggregated summaries of posts over a period.
Most features are available free of charge. Selected features may require a Premium subscription.
3. Sign-up and account
- Sign-up is via email with a one-time code (OTP).
- One account per person. You may not register multiple accounts or transfer access to a third party.
- Account security (including email and PIN access) is the user’s responsibility.
- Age: 18+. The Service is not directed to children. If you are younger, do not use the Service.
4. User content
All texts, photos and other materials you upload (“your content”) remain your property. By submitting content to the Service, you grant the Operator a worldwide, royalty-free, non-exclusive, revocable licence to store, process and display your content solely to provide you with the Service (including transmission to AI providers for response generation).
The Operator does not sell your content, does not use it for advertising and does not train AI models on it.
5. Prohibited content and conduct
Inside the Service and in ephemeral chats you may not:
- post or transmit material that is illegal under applicable law (including content sexualising minors, terrorism, incitement to violence, or hate speech against protected groups);
- threaten, insult or harass other users;
- post other people’s personal data without their consent;
- use the Service for spam, advertising, or manipulation;
- circumvent technical limits, reverse-engineer the API, or run load tests without prior coordination with the Operator.
Violations are grounds for account suspension without refund. Severe violations may be reported to law enforcement and relevant industry hotlines (e.g., NCMEC for CSAM).
6. AI features
AI responses are generated automatically and may contain errors or inappropriate text. AI responses are not medical, psychological, legal or other professional advice. If you have serious concerns about your mental or physical health, please consult a qualified professional. If you are in crisis, please contact your local emergency services.
If an AI comment upsets you — delete it in the app and, if you wish, let us know so we can investigate.
7. Ephemeral chats
- A chat lasts up to 60 minutes; individual messages disappear 60 seconds after delivery.
- Partner matching is anonymous. We do not verify the identity of the other party — communicate accordingly.
- Screenshots by the other side are technically possible (we do not notify you of them). Do not send anything you would not say to a stranger.
- A “report” feature is available — use it if sections 5–7 are violated.
8. Sharing posts
- Only you decide what to make public and when.
- A public link returns the fields you selected without authorisation, and search engines may index it.
- You may revoke a link at any time — the page will return HTTP 410 Gone and quickly drop from search results. However, if someone has saved a copy, we cannot control that.
9. Paid features (Premium)
If you enable a Premium subscription, the terms (price, billing period, payment method) are shown at purchase and take precedence over the general terms of this section.
Subscriptions auto-renew unless cancelled. You can cancel via the relevant app store (Apple App Store, Google Play) or payment processor. Refunds for unused periods are governed by the store’s or processor’s rules.
10. Account deletion and termination
You can delete your account at any time: in the App, go to Settings → Delete account; or use our public form at onemy.day/delete-account. All associated data is erased — this is irreversible.
The Operator may restrict or terminate access:
- upon breach of these Terms;
- upon a lawful request from authorities;
- for technical reasons (e.g., resource abuse).
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE OPERATOR DOES NOT WARRANT THAT:
- the Service will be uninterrupted, secure, or error-free;
- content will be preserved (please keep your own copies of important material);
- AI responses will be useful, accurate, or appropriate.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATOR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES OR DATA. THE OPERATOR’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS IS LIMITED TO THE GREATER OF (A) USD 100, OR (B) THE AMOUNTS YOU PAID TO THE OPERATOR FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow the exclusion or limitation of certain damages; the limits in this section apply only to the extent permitted by your local law.
13. Indemnification
You agree to indemnify and hold harmless the Operator, its officers, directors, employees and agents from any third-party claims arising from (a) your content, (b) your breach of these Terms, or (c) your violation of applicable law.
14. Changes to the Service and these Terms
The Operator may develop the Service: add, change or remove features. We will notify users of material changes to these Terms via a banner in the app or on the landing page. If the new version does not suit you — you may delete your account; continued use means acceptance.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to personal jurisdiction in those courts. Nothing in this section prevents either party from seeking injunctive relief in any competent court.
If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws grant you additional rights, those rights are not affected by this section.
